These Terms of Service (“Terms”) govern your use of this website and the free design programme offered by Solution Bowl (India) Private Limited (“Solution Bowl”, “we”, “us”) to founders located in Australia. By using the site or submitting an application, you agree to these Terms.
1. The free design programme
Solution Bowl offers a limited number of complimentary UI design engagements per month to qualifying founders. Submitting an application does not guarantee acceptance. We select participants based on fit, capacity, and the information you provide. We confirm acceptance and the engagement scope in writing before any work begins.
2. Eligibility
- You must be at least 18 years old.
- You must be authorised to represent the business named in your application.
- The information you provide must be accurate and complete.
- The programme is intended for founders located in Australia.
3. What's included, and what isn't
If your application is accepted, the deliverables, timeline, and revisions for the free engagement will be confirmed in writing before work starts. Anything outside that confirmed scope (including engineering, ongoing iteration, or additional surfaces) is offered as a paid service at our standard rates.
4. Intellectual property
- On final delivery and your written acceptance, you own the deliverables created specifically for your project.
- We retain ownership of underlying methodologies, design systems we already own, and any tooling we built to produce the work.
- We may showcase the delivered work in our portfolio, on our website, and in case studies, unless you tell us otherwise in writing before delivery.
5. Acceptable use
You agree not to:
- Submit false, misleading, or impersonating information.
- Use the site or our services to do anything illegal, harmful, or fraudulent.
- Attempt to interfere with, probe, or reverse-engineer any part of the site or our systems.
- Resell or sublicence deliverables to third parties without our prior written consent.
6. Confidentiality
Both parties agree to keep non-public information shared during the engagement confidential and to use it only for the purposes of the engagement.
7. Australian Consumer Law
Where you use the site or our services as a “consumer” under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), you have certain rights and consumer guarantees that cannot be excluded, restricted, or modified. Nothing in these Terms operates to exclude, restrict, or modify any rights or guarantees you have under the Australian Consumer Law.
To the extent that the Australian Consumer Law permits us to limit our liability for a breach of a non-excludable consumer guarantee, our liability is limited, at our option, to the resupply of the relevant services or the payment of the cost of resupply.
8. Disclaimers
Subject to clause 7, the site and any free deliverables are provided “as is” without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.
9. Limitation of liability
Subject to clause 7 and to the maximum extent permitted by law, Solution Bowl will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, business opportunity, goodwill, or data, arising out of or related to your use of the site or the programme. Our total aggregate liability for any direct loss is limited to the fees actually paid by you to us in the 12 months preceding the claim, which in the case of the free programme is nil.
10. Indemnity
You agree to indemnify Solution Bowl against any loss, cost, or claim arising from your breach of these Terms, your misuse of the site, or your infringement of a third party's rights, except to the extent caused by our negligence or wilful misconduct.
11. Termination
We may decline an application or terminate an engagement at our discretion, including if you breach these Terms or if circumstances make continued performance impractical. Clauses that by their nature should survive termination (including IP, confidentiality, liability, and governing law) survive.
12. Changes to these Terms
We may update these Terms from time to time. The current version is always at this URL, with a revised “Last updated” date. Continued use of the site after changes means you accept the updated Terms.
13. Governing law and jurisdiction
These Terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them, in respect of any dispute arising out of or relating to these Terms or the engagement.
